Declaration by the Danish Presidency on the new draft regulation in matters of succession
The Danish Presidency welcomes the adoption today by the European Parliament of its position at first reading relating to the proposed Regulation of the European Parliament and of the Council on jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of succession and the creation of a European Certificate of Succession
The adoption of this position by the European Parliament bears witness to the fruitful cooperation between the Council and the European Parliament which has enabled the two institutions, through intensive contacts, to agree on the shape of the new Regulation
Getting this far has required huge efforts on the part of all those involved in the negotiations. The new Regulation is groundbreaking Union legislation. It touches on matters of a very sensitive nature which have until now been excluded from Union instruments adopted in the area of judicial cooperation in civil matters. Considering the differing legal traditions of the Member States with regard to succession, a delicate balance has had to be struck to accomodate, as far as possible, the legitimate concerns of all Member States. To allow the new Regulation to become a reality, concessions have had to be made by all during the negotiation process
An important step towards easing the settlement of cross-border successions within the Union will have been made when, in the near future, the final adoption of the Regulation takes place in the Council
